4. The recently passed House bill (H.R. 1 – One Big Beautiful Bill) includes a provision (Sec. 112031 at p. 1041) that ends de minimis by deleting 19 U.S.C. Sec. 1321(a)(2)(B) which is a universal ban on duty-free entry of shipments under $800 from any country and there are penalties ($5,000 for first offense and $10,000 subsequent violations) for attempts to introduce articles in violation of section. This provision takes effect July 1, 2027.

9. The first lawsuit challenging President Trump’s imposition of tariffs under IEEPA on de minimis shipments has been filed, Axle of Dearborn, Inc. v. Department of Commerce, et al., Case 1:25:cv:00091-N/A. The company has requested expedited scheduling with a Motion for a Preliminary Injunction and Partial Summary Judgment. Companies who wish to challenge the tariffs will need to either file a protest with CBP on all the entries with the tariffs or file a lawsuit with the U.S. Court of International Trade.
